By enrolling in classes or participating in any activity offered by EKAM SOUL, you are entering into a service agreement and agree to the following terms.

1. Health, Safety, and Medical Clearance

• Physical Readiness: I confirm that I am physically capable of participating in the yoga classes, wellness programs, and fitness activities (the "Services") provided by EKAM SOUL.

• Medical Consultation: I understand participation involves risks of injury. If I am pregnant, have a pre-existing injury, or have any medical condition, I confirm I have consulted a medical professional and am cleared to participate.

• Self-Monitoring: I take full responsibility for my physical well-being during class and agree to stop or modify my practice if I experience pain, dizziness, or discomfort.

• Right of Refusal: EKAM SOUL reserves the right to refuse participation for medical or safety reasons.

2. Assumption of Risk & Release of Liability

• Assumption of Risk: I voluntarily assume full responsibility for all risks, injuries, or damages that may arise from my participation, including those resulting from negligence.

• Release of Claims: I voluntarily release and discharge EKAM SOUL, its instructors, employees, and venue partners from any liability, claims, or actions related to injury, property damage, illness, or death sustained during the Services.

• Indemnification: I agree to hold EKAM SOUL harmless from any legal expenses or liabilities arising from claims made by me or on my behalf, extending to my heirs and assigns.

3. Media Release

• EKAM SOUL may photograph or film activities within the studio. I grant permission for my image or voice to be used in promotional materials, website content, and social media without compensation.

4. Cancellation & No-Show Policy

• The 6-Hour Window: You may cancel or reschedule without penalty up to 6 hours before class begins, and your credit will be returned.

• Late Cancellations: Cancellations within 6 hours, or no-shows, will result in the deduction of one (1) class credit from your package.

• How to Cancel: Please cancel your reservation on our website. In case of sudden emergencies, please contact us ASAP to review your situation.

5. Refund Policy

• General Policy: Payments for rendered services are strictly non-refundable. Unused services are also non-refundable, except in the following cases:

  • EKAM SOUL fails to deliver a scheduled service.

  • Services are discontinued for over 30 days, and you decline an extension.

  • A significant personal change prevents your physical attendance for over 6 months.

• Processing: Eligible refunds are granted on a pro-rata basis and are subject to deductions for payment gateway fees, bank fees, and applicable taxes.

6. Governing Law

• This agreement is governed by the laws of the Republic of the Philippines, and any disputes shall be filed in the courts of Quezon City. If any provision is deemed invalid, the rest of the agreement remains in effect.

 

Signing up on our classes confirms that you have carefully read this Agreement, understand its contents, and voluntarily agree to its terms. You understand that you are waiving substantial legal rights, including the right to sue.
